Delhi Court Denies Bail to the Accuse of Parliament Security Breach

New Delhi: On Wednesday, a Delhi court denied Neelam Azad’s bail application. Azad is one of six people charged in the December 13, 2023, Parliament security breach case.

The Patiala House Court declined to release Azad on normal bail, citing sufficient reasonable grounds to believe that the charges against the accused were prima facie accurate.

Azad’s previous bail application, filed in January of this year, was also rejected.

On December 13, 2023, the 22nd anniversary of the 2001 Parliament terror attacks, two accused jumped onto the floor of the Lok Sabha, released yellow gas and raised slogans before being overpowered by MPs, while Azad and Amol Shinde sprayed coloured gas from canisters while shouting slogans outside Parliament premises.

Based on a report from a security official in the Lok Sabha, the Delhi Police opened a case against the accused at the Parliament Street Police Station under Sections 186, 353, 452, 153, 34, and 120B of the IPC and 13, 16, and 18 of the Unlawful Activities (Prevention) Act (UAPA).

Delhi Police’s Special Cell had already filed its first charge sheet, which spans over 900 pages, against all six accused: Azad, Shinde, Manoranjan D., Sagar Sharma, Lalit Jha, and Mahesh Kumawat.

They are currently in judicial custody. Jha is thought to be the brain behind the entire plan, and he reportedly fled with the mobile phones of the four other suspects. Kumawat was also linked to the suspects. V.K. Saxena, the Lieutenant Governor of Delhi, has also sanctioned prosecution against the six suspects under the Unlawful Activities (Prevention) Act. The Delhi Police had requested prosecution under Sections 16 (terrorism) and 18 (conspiracy for terrorism) of UAPA from the competent authority, i.e. the L-G, who approved after determining adequate evidence on record.
